1. General Terms

These Terms of Service ("Terms") govern all services provided by DigitalVisionCraft, located at Im Eichengrund 3, 49770 Dohren, Germany. By engaging our services or accessing this website, you agree to be bound by these Terms. DigitalVisionCraft provides digital strategy consulting, UI/UX design, and interface architecture services to businesses and individuals.

2. Service Scope & Deliverables

All service engagements are defined in individual project proposals or statements of work ("SOW"). Each SOW specifies deliverables, timelines, pricing, and acceptance criteria. DigitalVisionCraft will perform services with reasonable skill and care consistent with industry standards for digital strategy and design.

  • Scope changes requested after SOW approval may incur additional fees
  • Deliverables are provided in standard digital formats (Figma, PDF, HTML)
  • All work is performed remotely unless otherwise agreed in writing

3. Payment Terms

All invoices are payable within 14 days of the invoice date unless otherwise specified in the SOW. DigitalVisionCraft accepts payment via bank transfer and Stripe. Late payments incur a statutory interest rate of 9 percentage points above the ECB base rate per annum (§288 BGB).

  • Project deposits of 50% are required before work commences
  • Milestone payments are billed upon delivery and acceptance
  • All prices are quoted in EUR and include applicable VAT unless stated otherwise

4. Intellectual Property

Upon full payment of all applicable fees, the client receives full ownership of all final deliverables produced under the SOW. DigitalVisionCraft retains the right to display completed work in its portfolio and marketing materials unless a non-disclosure agreement (NDA) is in effect. Pre-existing tools, frameworks, and methodologies remain the intellectual property of DigitalVisionCraft.

5. Limitation of Liability

DigitalVisionCraft's total aggregate liability under any engagement shall not exceed the total fees paid by the client for the specific project giving rise to the claim. DigitalVisionCraft shall not be liable for indirect, consequential, or incidental damages, including lost profits, data loss, or business interruption, except in cases of gross negligence or willful misconduct.

6. Confidentiality

Both parties agree to maintain the confidentiality of all proprietary information shared during the course of the engagement. This obligation survives termination of the agreement for a period of 3 years.

7. Termination

Either party may terminate an engagement with 14 days' written notice. In the event of termination, the client is liable for all work completed up to the termination date. Any outstanding deliverables and payments shall be settled within 30 days of the termination date. Work products completed and paid for prior to termination will be transferred to the client.

8. Governing Law

These Terms are governed by the laws of the Federal Republic of Germany. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Aurich, Lower Saxony, Germany.

Refund & Reimbursement Policy

1. General Refund Principles

DigitalVisionCraft is committed to delivering high-quality digital strategy and design services. We recognize your right to a fair refund process as a consumer under German law. This policy outlines the conditions under which refunds or partial reimbursements may be granted for services provided from our office at Im Eichengrund 3, 49770 Dohren, Germany.

2. Project Deposit

The 50% project deposit paid before commencement of work is non-refundable once work has begun, as it covers initial resource allocation, project planning, and opportunity cost. The deposit becomes refundable only if DigitalVisionCraft fails to commence work within the agreed timeframe for reasons attributable to DigitalVisionCraft.

3. Milestone-Based Refunds

For projects structured around milestone payments, refunds are calculated based on the following framework:

  • Pre-Start Cancellation: Full refund of deposit minus 10% administrative fee
  • During Active Phase: Payment for completed work + 50% of the current active phase fee
  • Post-Delivery: No refund once deliverables have been accepted and approved by the client

4. Scope Changes & Additional Work

If the client requests changes that fall outside the originally agreed SOW, DigitalVisionCraft will provide a separate quote for additional work. The client may decline the additional work without affecting the original agreement. No refund will be issued for work that has been completed and approved within the original scope.

5. Dissatisfaction & Quality Disputes

If the client is dissatisfied with delivered work, DigitalVisionCraft offers up to 2 rounds of revision at no additional cost, provided the revisions fall within the original SOW scope. If dissatisfaction persists after revisions, both parties agree to enter mediation. If mediation fails, the client is entitled to a pro-rata refund for undelivered portions of the project.

6. Refund Process

To request a refund, contact DigitalVisionCraft in writing at [email protected] or by post to Im Eichengrund 3, 49770 Dohren, Germany. Include the project name, invoice number, and reason for the refund request. Refund requests will be reviewed and resolved within 14 business days. Approved refunds are processed to the original payment method.

7. Consumer Rights

Nothing in this policy affects your statutory rights as a consumer under German law (§§ 434–442 BGB) or the EU Consumer Rights Directive (2011/83/EU). If you have a legal right to a refund that supersedes this policy, that right will be honored in full.
